1) Acceptance of These Terms

By requesting an estimate, scheduling, purchasing, or receiving services from Elevation Outdoor Services, you agree to these Terms. If you do not agree, do not use our services or contact channels.

2) Our Services

We provide outdoor and site work services which may include (as applicable):

  • Concrete (e.g., patios, driveways, sidewalks, commercial concrete)
  • Hardscapes / retaining walls (including drainage considerations)
  • Excavation / site preparation (grading/digging and related prep)
  • Fiberglass pool installation (including excavation, concrete work, and yard restoration; including San Juan pools)

Free estimates may be available for many projects.

3) Estimates, Proposals, and Scope of Work

  • Estimates are based on information available at the time (site conditions, access, materials, and requested scope).
  • Final scope, pricing, and timelines are confirmed in a written proposal/work order/invoice.
  • Change orders: If you request changes (materials, design, added work) or site conditions require changes (e.g., unexpected subsurface conditions), we'll document changes and any price/timeline impacts before proceeding when reasonably possible.

4) Scheduling, Site Access, and Customer Responsibilities

You agree to:

  • Provide safe and reasonable access to the work area (including gate access, pets secured, and clear paths).
  • Mark or disclose known underground hazards (e.g., sprinkler lines, septic, private utilities) and obtain any approvals you control (HOA, neighbor access permissions, etc.).
  • Ensure utilities are located/marked where required. (We may coordinate utility locate requests where customary, but you remain responsible for ensuring the site is ready and safe.)

5) Weather and Delays

Outdoor construction can be impacted by weather, material availability, inspections, and permitting. Start dates and completion timelines are good-faith estimates and may change due to conditions outside our control.

6) Permits and Compliance

Where permits are required, responsibility will be defined in your written proposal (Elevation or the customer). You agree to cooperate with permit/inspection requirements if applicable.

7) Payments, Deposits, and Non-Payment

  • Payment terms (deposit amount, progress payments, final payment due date, accepted payment methods) will be stated in your proposal/invoice.
  • Late or unpaid balances may result in paused work, rescheduling, and/or late fees where permitted by law and stated in your invoice/contract documents.

8) Cancellations and Rescheduling

If you need to cancel or reschedule, please contact us as soon as possible via phone (859-544-0500) or our contact form.

Cancellation/reschedule fees (if any) will be communicated in advance and/or included in your written proposal.

9) Warranties and Workmanship

Any workmanship warranty (if offered) will be described in your written proposal/invoice and may exclude normal wear, damage due to misuse, acts of nature, drainage/settling outside design assumptions, or work performed by others.

10) Property Condition, Debris, and Cleanup

We aim to respect your property and complete cleanup appropriate to the project, including hauling away debris when the work is complete, unless otherwise agreed.

11) Photos and Project Documentation

We may take photos/videos of the work area and completed projects for documentation, quality control, or portfolio purposes. If you want to opt out of marketing use, notify us in writing before work begins.

12) Limitation of Liability

To the fullest extent permitted by law, Elevation is not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim will not exceed the amount paid for the specific services giving rise to the claim, except where prohibited by law.

13) Dispute Resolution

If an issue arises, you agree to contact us first so we can try to resolve it quickly. Any formal dispute process (mediation/arbitration/court venue) may be specified in your written proposal/contract if applicable.
